1. Relevance

These shipping- and general terms and conditions are relevant to all offers of Nuala regarding Nuala art (after this Nuala-Art) and on all agreements with us. Only after written consent by Nuala-Art is it possible to divert from these terms and conditions, in which case the other terms are still valid.

  1. Offers / agreements

The offered goods and / or services are clearly and thruthfully depicted and / or described and as complete as reasonable. If there is a limited availability to our offer, this limit will be clearly mentioned.

An agreement of purchase is made by placing an order through the Nuala-Art website; www.Nuala-Art.nl. The order is confirmed immediately after placing the order through a PDF file that is sent to the costumer by email. If you see a wrongfully ordered product in this confirmation, you should immediately contact us, so we can adjust it for you. Mistakes and errors are otherwise fully at risk and on account of the customer.

All offers of Nuala-Art are non-commital and Nuala-Art explicitly reserves the right to change prizes. An agreement is only made after Nuala-Art accepts your order. Nuala-Art has the right to deny orders or place certain conditions on an order, unless explicitly stated otherwise. If an order is not accepted, Nuala-Art notifies this within ten working days after the order has been made.

Nuala-Art is not responsible for typo’s or other mistakes on her website.

  1. Prices

The price mentioned by us is including salestax and in euros unless otherwise mentioned, but excluding packaging and postage. All prices are condition to changes.

  1. Payment

Payment can be conducted through iDeal or Paypal, as well as in advance through bank transfer. If a payment through iDeal or Paypal fails, the website gives you the opportunity to pay in another way. The order won’t be processed until the payment through iDeal or Paypal has succeeded, or once advance payment through banktransfer has been selected. If we have not received your payment within three weeks, we will consider your order void. You can order the articles again against the then valid prices.

It is not possible to send as cash on delivery.

  1. Shipment

Netherlands:
The ordered goods are usually shipped within three days after receiving the payment. Delivery usually takes place within two days after shipping.

Europe:

The ordered goods are usually shipped within three days after receiving the payment. Delivery usually takes place within eight days after shipping.

Rest of the world:

The ordered goods are usually shipped within five days after receiving the payment. Delivery usually takes place within seven days after shipping.

The delivery terms described by Nuala-Art are only indicative. Exceeding any delivery term does not give you the right to claim damages.

If an article is not available, we will contact you.

In the exceptional case an article is not available anymore, Nuala-Art always reserves the right to either deliver a comparable product concerning price and quality free of charge, or reimbursing the customer for the amount paid, depending on the customers choice.

In case of a delivery that is not on time you should contact us.

After exceeding the term of delivery with over thirty days Nuala-Art as well as the customer have the right to dissolve the agreement in writing, after which both parties are relieved of their obligation to each other and any already done payments will be reimbursed.

Nuala-Art is free to deliver the order in multiple parts to prevent a longer waiting period. The costs that are made for this are always for Nuala-Art.

If an article is not delivered in time you should contact us.

  1. Exchange

All articles can be exchanged or the purchage can be dissolved within 8 days after receiving. In this case you need to send the invoice together with the article back to us postage paid (Servicepoint DHL). When returning the entire order you only have to pay 1.00 euro shipping costs. The advance shipping costs will be settled with the restitution amount. If the order is only sent back in part we unfortunately cannot accomodate you on the shipping costs.

You need to mention on the invoice:

  • The date of receiving the item
  • Reason for returning the item
  • If you wish another product or restitution.
  • The necessary bankaccount information, for restitution of the payment (which would definitely take place within two weeks).

In the following situations exchange is not possible:

  • Jewelry/products that have been worn and / or have been damaged by you.
  • If you tried to fix a fault yourself.
  • If you didnt follow the user manual and / or instructions.
  • If the article is not sent back in original state. (packaging etc.)
  1. Production errors

If there are clear production errors to an article (or if we have sent you something wrong) please contact us within 14 days after receiving the item.

After receiving the articles, please check them. Because we ship many products that are entirely handmade, small deviations in model and / or colour can occur.

You need to send your invoice together with the article to us, postage paid (these shipping costs will be reimbursed by Nuala-Art. Attention: This is only valid if there is something wrong with the article outside of your responsibility).

You need to mention on the invoice:

  • If you wish another product or restitution.
  • The necessary bankaccount information, for restitution of the payment (which would definitely take place within two weeks).

  1. Shipments/Shipping costs

Shipping is done at risk of the seller. The choice of shipping method is up to us. The time of juridical delivery is the moment the articles leave our company.

When paying through our website the shipment costs are mentioned. These costs are calculated according to weight and region. Because of this it can occur that shipment costs are adjusted later on. In this case Nuala-Art will always contact you, and you can always cancel the agreement to buy.

Nuala-Art is free to deliver the order in multiple parts to prevent a longer waiting period. The costs that are made for this are always for Nuala-Art.

As soon as the to be delivered articles have been delivered to the customer at the destination, the risk for these articles transfers to the customer.

  1. Privacy law

We will never transfer data from our customerbase to third parties without your express consent.

In our secured database we keep the folowing records of you:

  • Name and address
  • E-mail address
  • Telephone number
  • Order details

These data are only used for handeling the shipment and for purpose of communication concerning the made order and payments. You will only receive advertisement for Nuala-Art (our newsletter) if you have explicitly requested this on the website.

If you want to be deleted from our database entirely, you can contact us.

  1. Force majeure

Unabated by the other applicable rights, in case of force majeure, Nuala-Art has the right to chose to either suspend the order or to dissolve the agreement without judicial intervention, to give you a written confirmation of this, without any need for damages to be paid by Nuala-Art, unless this would be unacceptable to the measures of reason and fairness. With force majeure we understand every shortcoming that cannot be accounted to Nuala-Art, because it’s not her fault and is not responsible by law, legal act or in traffic valid reasons.

  1. Accountability

For any direct or indirect damages for which Nuala-Art has not explicitly accepted responsibility, Nuala-Art will not be responsible, except for damage that has been caused intentionally or because of gross negligence on part of Nuala-Art. The customer safeguards Nuala-Art in this place from all claims by third parties. The accountability of Nuala-Art is limited at all times up to the amount of the invoice of the concerned shipment, or the amount that Nuala-Art could have maximally charged the customer. The limitation of the accountability as stipulated in this article is valid in equal parts for collaborators, employees and all other people that are a part of the execution of the agreement by Nuala-Art.

  1. Other stipulations

If deviation from these terms and conditions, for short or longer term, whether or not silently is accepted by Nuala-Art, this does not impede her right to demand a direct and strict compliance of these terms and conditions.

You can never assert any rights based upon the fact that Nuala-Art is lenient in applying these conditions.

In the case that seperate, in these terms and conditions included, stipulations would entirely or partially lose their function, this will not have any consequences for the validity of the remaining stipulations of these terms and conditions.

In case of affairs that are not accounted for in these terms and conditions you can contact Nuala-Art.

  1. Applicable law and authorized judge.

Only Dutch law is applicable to all rights, liabilities, promotions, orders and agreements to which these terms and conditions apply. All differences between parties will be exclusively presented to an authorized judge in the Netherlands.
